My response to the Patriot Act that ain’t patriotic.
After the Revolution against the British and the US Constitution set in stone the common law was set to be obeyed after the Constitution because the Constitution was created to be the major law of the land before anything else. That means people and government alike should obey the Constitution, then bill of rights, and then the common law passed and set by the Congress and Senate. If somebody didn’t agree with a amendment then that person can be free to challenge the amendment by a Constitution changing ceremoney and can only happen if approved by both the Congress and We the People.
These days after the terrorist attacks of 9/11 and the passing of the Patriot Act the Constitution started becoming the 2nd law while the Anti-Terrorism laws became first. This now means that we have to obey common laws before the Constitution? This doesn’t seem right! How could we have become a society where common law should be obeyed before the Constitution. Even legal advisers are for being forced to obey common laws before the Constitution even if that particular law is Unconstitutional. One of them said that we should have to obey every law even if it’s Unconstitutional and if we don’t agree with that Unconstitutional law then we take it to supreme court well if it’s going to be like that then technically the Constitution doesn’t exist and that now common laws can override the Constitution. If that is true then the US Constitution is no more, human rights are no more, bill of rights are no more, and technically the US is no longer a free country as long as the leaders make sure we can’t start a civil war or revolution using weapons including bombs (cause simple guns can’t fight tanks, and bullet proof vest wearing totalitarian soldiers), cannons, and guns since bombs are considered a terrorist using tool and guns are being outlawed or restricted at many levels.
If we can’t go to the war with the Federal Government, and if Common law now overrides the Constitution then technically we are not in a free country anymore and are heading straight for a totalitarian state with no hope of stopping it. The only things we can do are use the legal system against those abusing their authority or a revolutionary (or civil) war against the federal government so in other words it’s war or peacefully resolve the issues with our rights. If both are taken away then we will become exactly like George Orwell’s 1984 because then theres nothing to keep the government in check. If we can’t own weapons and our peaceful rights can be stolen easily then we have no more free will because then a government can do whatever it wants whenever it wants.
Whether we like it or not a government has to be put in check and a Constitution is the best way to do it. If the common law is the boss and the Constitution isn’t the main law before Constitutional law then we are no different then Britain because Britain has no written Constitution so technically the law makers can do what they want there and the Vatican catholic church can attack people there since there ain’t a federal level rights, checks, and balances kinds of systems in place like we do here.
I hope the Patriot Act can be repealed, and we should put into definition again that we should not obey any law that’s Unconstitutional and any laws that are against the Constitution should be repealed if passed and the senators jailed and charged with disobeying their Oaths to protect the Constitution from enemies foreign and domestic. The judicial branch and even the executive branch shouldn’t even be passing Unconstitutional bills in the first place and if they don’t like it they should explain to the people why a certain amendment should be changed then if the majority agrees then vote to change a Constitutional amendment but until then they need to just say nay to all bills that violate the Constitution and that is that.
